Terms of Service

These Terms of Service govern access to and use of Worqa by companies, administrators, employees, managers, recruiters, applicants, and other authorized users who access the platform. By creating an account, accessing a workspace, or using any Worqa feature, you agree to these terms on behalf of yourself and, where applicable, the organization you represent.

Platform scope

Worqa provides software for workforce operations, including hiring, onboarding, attendance, payroll preparation, scheduling, approvals, reporting, documents, notifications, integrations, billing controls, and related automation. Specific features may vary by plan, module activation, workspace configuration, and connected services.

We may introduce, modify, or retire features over time in order to improve reliability, security, and product performance.

Eligibility and authority

You may use Worqa only if you can form a binding agreement and are authorized to do so. If you create or administer a workspace for a company, you represent that you have authority to bind that organization to these terms and to manage data, users, and settings within the workspace.

You are responsible for ensuring that all users in your organization use the platform in accordance with internal policy, applicable law, and these terms.

Accounts and workspace administration

Customers are responsible for maintaining accurate account information, safeguarding credentials, assigning appropriate roles and permissions, reviewing audit activity, and promptly disabling access for users who should no longer use the platform.

Administrators control many workspace-level settings, including document visibility, attendance policy, payroll configuration, recruiting flows, notification routing, and integration access. Worqa is not responsible for decisions made by customer administrators inside their own workspace.

Acceptable use

You may not use Worqa to violate the law, infringe intellectual property or privacy rights, transmit malware, attempt unauthorized access, interfere with service operation, scrape or reverse engineer the platform beyond what applicable law permits, or use the platform to store or distribute harmful, deceptive, or abusive content.

You may not use Worqa in a way that disrupts other customers, bypasses subscription limits, misrepresents payroll, employment, or applicant information, or exposes the platform to security, fraud, or regulatory risk.

Customer data and instructions

Customers retain responsibility for the accuracy, legality, quality, and rights associated with the information they submit to Worqa. That includes workforce records, payroll inputs, applicant data, uploaded documents, and content sent through connected services.

You authorize Worqa to host, copy, transmit, and process customer data only as needed to provide the service, maintain security, support integrations, and carry out documented customer instructions.

Subscriptions, fees, and billing

Paid access to Worqa may be governed by a subscription plan, order form, invoice, or other commercial agreement. Customers are responsible for applicable fees, taxes, renewal obligations, payment authorization, purchased seat limits, additional seat charges, and account funding required to keep service active.

If payment fails or a subscription expires, Worqa may continue full access for a short grace period, then move the workspace into read-only mode while the customer still has access to historical records and billing recovery. If the account remains unresolved, the workspace may later be archived and eventually deleted in line with the retention and notice periods described in our legal and billing materials. Fees already paid are generally non-refundable unless otherwise required by law or expressly stated in a separate commercial agreement.

Service access after expiry

When a subscription ends, Worqa does not immediately erase customer data. During the grace period, the workspace may remain fully available while billing reminders are delivered. After grace, the workspace may move into read-only mode, which means historical data stays accessible but new activity such as attendance declarations, approvals, payroll runs, and other write actions may be paused until renewal.

If the workspace is not restored within the reactivation window, Worqa may archive it. Archived workspaces are preserved for a limited period and may still be reactivated before final deletion. After the final retention window expires, Worqa may permanently delete the workspace and associated records, subject to backup, compliance, and legal retention requirements.

Availability and support

We work to keep Worqa available, secure, and reliable, but the platform is provided on an evolving basis and may be unavailable from time to time due to maintenance, third-party failures, security events, capacity constraints, or factors outside our reasonable control.

We may provide support, onboarding, migration help, or operational guidance, but support interactions do not transfer responsibility for customer configuration, payroll decisions, employment actions, or compliance obligations to Worqa.

Intellectual property

Worqa and its underlying software, workflows, visual assets, product copy, documentation, and service design are owned by Worqa or its licensors and are protected by intellectual property laws. These terms grant a limited, non-exclusive, non-transferable right to use the service during an active subscription or authorized access period.

Customers retain ownership of their own data, uploaded content, and trademarks.

Confidentiality, disclaimers, and liability limits

Each party should protect the other party’s confidential information using reasonable care and use that information only for purposes related to the service relationship. The platform is provided on an as available basis except to the extent a separate written agreement states otherwise.

To the maximum extent permitted by law, Worqa is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data arising from use of the service. Worqa is not responsible for employer decisions, payroll calculations based on customer inputs, applicant screening choices, or third-party services enabled by the customer.

Suspension, termination, and changes

We may suspend access if necessary to address security issues, suspected fraud, non-payment, abusive activity, or violations of these terms. Customers may stop using the service at any time, subject to any active subscription, active invoice, retention window, or other commercial commitments.

Workspace termination does not mean immediate deletion. Data may remain available during grace, read-only, and archive periods before permanent deletion occurs. We may update these terms from time to time. Continued use of Worqa after an update takes effect means the updated terms apply. Questions about these terms can be sent to chigo@worqa.xyz.
